Agreement to terms
These Terms of Service ("Terms") govern your access to and use of BIG PICTURE MARKETING STUDIO (the "Service"), provided by BIG PICTURE MARKETING STUDIO ("we", "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility and accounts
You must be at least 18 years old and able to enter a binding contract to use the Service. You are responsible for the information you provide, for keeping your password secure, and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
Your content
You retain ownership of the content you upload, generate, or publish through the Service, including listings, contacts, headshots, logos, copy, and posts ("Your Content"). You grant us a worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to operate, secure, and improve the Service and to publish on the channels you connect.
Acceptable use
You agree not to use the Service to publish unlawful, infringing, deceptive, harassing, or spam content; to violate the rules of any connected social network or real estate board; to scrape, reverse engineer, or interfere with the Service; or to import contacts you do not have permission to message. We may suspend or terminate accounts that violate these rules.
Connected third-party services
The Service lets you connect external accounts (e.g. Facebook, Instagram, LinkedIn, Threads, Pinterest, Google Business Profile, YouTube, email, and AI providers). Your use of those services is governed by their own terms. We are not responsible for outages, policy changes, or account actions taken by third parties.
AI-generated content
The Service uses AI to draft copy, captions, and other marketing assets. AI output can be inaccurate or include third-party material. You are responsible for reviewing AI-generated content before publishing and for ensuring it complies with applicable laws, MLS rules, and advertising regulations in your jurisdiction.
Fees and billing
Paid plans are billed in advance on a recurring basis until cancelled. Fees are non-refundable except where required by law. We may change pricing on renewal with prior notice. Taxes are your responsibility unless stated otherwise.
Cancellation and termination
You may cancel your account at any time from the Service. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; we may delete Your Content after a reasonable retention period.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific marketing results, lead volume, listing performance, or commissions.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.
Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.
Changes to the Service or Terms
We may update the Service and these Terms from time to time. If we make material changes to the Terms, we will notify you through the product or by email. Continued use of the Service after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless local consumer law provides otherwise.
